Adakah Nazri memahami apa yang tersurat dan tersirat di dalam Artikel 153 berkenaan Hak Keistimewaan orang Melayu? Adakah Abdullah Ahmad Badawi menyedari implikasi tindakan Menteri JPM ini yang pasti pengumuman ini dibuat atas pengetahuannya?
Abdullah dan slogan hipokrasi Agenda Melayunya mula bertambah nyata. Jika pemberhentiaan beramai-ramai pekerja Melayu, penggantiaan CEO Melayu dengan CEO bukan Melayu, dan kemudian diambil kembali pekerja bukan Melayu untuk mengganti, diguna justifikasi perniagaan.
Kemudian WPI diumumkan akan memberhentikan DEB dan akan dikembangkan ke seluroh negara, ini tidak dipercayai. Kini perkara hak pula dicerobohi.
Adakah orang Melayu sudah sedia dan berupaya menerima semua ini tanpa bangkangan?

Biasiswa JPA pelajar bukan Melayu naik kepada 45 peratus
KUALA LUMPUR 28 Mei – Biasiswa Jabatan Perkhidmatan Awam (JPA) untuk program ijazah di luar negara kepada pelajar bukan bumiputera dinaikkan kepada 45 peratus daripada 10 peratus mulai tahun ini.
Menteri di Jabatan Perdana Menteri, Datuk Seri Mohamed Nazri Aziz berkata, secara keseluruhan sebanyak 2,000 biasiswa disediakan oleh JPA iaitu 1,100 untuk bumiputera dan 900 untuk bukan bumiputera.
“Pecahannya ialah 50 peratus untuk bumiputera dan 45 peratus kepada bukan bumiputera berbanding sebelum ini hanya 10 peratus sahaja diberikan kepada bukan bumiputera,” katanya ketika menggulung perbahasan mengenai Rang Undang-undang Perbekalan Tambahan 2008 (2007) melibatkan RM60 juta kepada JPA di Dewan Rakyat hari ini.
Nazri berkata, hanya mereka yang benar-benar layak akan menerima biasiswa itu kerana permohonan yang diterima ialah sebanyak 15,220.
Daripada jumlah itu katanya, hanya 7,282 dipanggil temuduga dan hanya mereka yang benar-benar menepati kriteria sahaja dipilih.
“Kriteria pemilihan ialah 70 peratus untuk akademik, 10 peratus kegiatan kokurikulum, 10 peratus latar belakang keluarga dan 10 peratus lagi temuduga,” katanya.
Nazri berkata, tajaan JPA adalah untuk pelajar yang mendapat tempat di universiti bertaraf “Ivy Leaque” dan yang setara dengannya di luar negara, serta bagi pengajian ijazah pertama di universiti kampus cawangan seperti di Universiti Monash, Universiti Nottingham dan Universiti Curtins.
Mulai tahun ini juga katanya, lepasan Sijil Pelajaran Malaysia (SPM) 2007 yang memperoleh 9A ke atas akan menerima biasiswa Jabatan Perkhidmatan Awam (JPA) untuk melanjutkan pengajian ke tingkatan enam di sekolah bantuan penuh kerajaan dan kursus matrikulasi serta asasi sains di institusi pengajian tinggi awam (IPTA).
Pelbagai pihak telah menyatakan reaksi kepada kenyataan Nazri. Pertama kedengaran adalah Majlis Muafakat Melayu Malaysia (MMMM) dan Angkatan Belia Islam (ABIM).
Selain itu, Badan Bertindak Perpaduan Melayu (BBPM) dan Gabungan Pelajar-Pelajar Melayu Semenanjung (GPMS) yang merupakan jaringan NGO-NGO yang didalangi oleh puak-puak penyokong Abdullah sudah juag bersuara.
Dr Mahathir memperingati mereka-mereka yang ingat orang Melayu sudah bersedia untuk bersaing supaya sedar dari realiti. Orang Melayu belum bersedia dan berupaya untuk saing. Mereka perlu dibantu dan di sokong.
Nazri berkata bahawa "biasiswa bukannya hak tetapi keistimewaan." Suggguhkah demikian?
Artikel 153
Artikel Perlembagaan Persekutuan Malaysia berkenaan hak keistimewaan orang Melayu, diulang lagi kata utamanya adalah hak dan keistimewaan, adalah Artikel 153. artikel itu adalah seperti berikut:
153. Reservation of quotas in respect of services, permits, etc., for Malays and natives of any of the States of Sabah and Sarawak
(1) It shall be the responsibility of the Yang di-Pertuan Agong to safeguard the special position of the Malays and natives of any of the States of Sabah and Sarawak and the legitimate interests of other communities in accordance with the provisions of this Article.
(2) Notwithstanding anything in this Constitution, but subject to the provisions of Article 40 and of this Article, the Yang di Pertuan Agong shall exercise his functions under this Constitution and federal law in such manner as may be necessary to safeguard the special position of the Malays and natives of any of the States of Sabah and Sarawak and to ensure the reservation for Malays and natives of any of the States of Sabah and Sarawak of such proportion as he may deem reasonable of positions in the public service (other than the public service of a State) and of scholarships, exhibitions and other similar educational or training privileges or special facilities given or accorded by the Federal Government and, when any permit or licence for the operation of any trade or business is required by federal law, then, subject to the provisions of that law and this Article, of such permits and licences. (NB: Article 40 of the Constitution provides that the Yang Di-Pertuan Agong is to act on advice of the Cabinet.)
(3) The Yang di-Pertuan Agong may, in order to ensure in accordance with Clause (2) the reservation to Malays and natives of any of the States of Sabah and Sarawak of positions in the public service and of scholarships, exhibitions and other educational or training privileges or special facilities, give such general directions as may be required for that purpose to any Commission to which Part X applies or to any authority charged with responsibility for the grant of such scholarships, exhibitions or other educational or training privileges or special facilities; and the Commission or authority shall duly comply with the directions. (NB: Part X is the provision with regard to Public Services.)
(4) In exercising his functions under this Constitution and federal law in accordance with Clauses (1) to (3) the yang di-Pertuan Agong shall not deprive any person of any public office held by him or of the continuance of any scholarship, exhibition or other educational or training privileges or special facilities enjoyed by him.
(5) This Article does not derogate from the provisions of Article 136 (Article 136 provides: All persons of whatever race in the same grade in the service of the Federation shall, subject to the terms and conditions of their employment, be treated impartially.)
(6) Where by existing federal law a permit or licence is required for the operation of any trade or business the Yang di-Pertuan Agong may exercise his functions under that law in such manner, or give such general directions to any authority charged under that law with the grant of such permits or licences, as may be required to ensure the reservation of such proportion of such permits or licences for Malays and natives of any of the States of Sabah and Sarawak as the Yang di-Pertuan Agong may deem reasonable; and the authority shall duly comply with the directions.
(7) Nothing in this Article shall operate to deprive or authorize the deprivation of any person of any right, privilege, permit or licence accrued to or enjoyed or held by him or to authorize a refusal to renew to any person any such permit or licence or a refusal to grant to the heirs, successors or assigns of a person any permit or licence when the renewal or grant might reasonably be expected in the ordinary course of events.
(8) Notwithstanding anything in this Constitution, where by any federal law any permit or licence is required for the operation of any trade or business, that law may provide for the reservation of a proportion of such permits or licences for Malays and natives of any of the States of Sabah and Sarawak; but no such law shall for the purpose of ensuring such a reservation:(a) deprive or authorize the deprivation of any person of any right, privilege, permit or licence accrued to or enjoyed or held by him; or
(b) authorise a refusal to renew to any person any such permit or licence or a refusal to grant to the heirs, successors or assigns of any person any permit or licence when the renewal or grant might in accordance with the other provisions of the law reasonably be expected in the ordinary course of events, or prevent any person from transferring together with his business any transferable licence to operate that business; or
(c) where no permit or licence was previously required for the operation of the trade or business, authorize a refusal to grant a permit or licence to any person for the operation of any trade or business which immediately before the coming into force of the law he had been bona fide carrying on, or authorize a refusal subsequently to renew to any such person any permit or licence, or a refusal to grant to the heirs, successors or assigns of any such person any such permit or licence when the renewal or grant might in accordance with the order provisions of that law reasonably be expected in the ordinary course of events.
(8A) Notwithstanding anything in this Constitution, where in any University, College and other educational institution providing education after Malaysian Certificate of Education or its equivalent, the number of places offered by the authority responsible for the management of the University, College or such educational institution to candidates for any course of study is less than the number of candidates qualified for such places, it shall be lawful for the Yang di-Pertuan Agong by virtue of this Article to give such directions to the authority as may be required to ensure the reservation of such proportion of such places for Malays and natives of any of the States of Sabah and Sarawak as the Yang di-Pertuan Agong may deem reasonable; and the authority shall duly comply with the directions.
(9) Nothing in this Article shall empower Parliament to restrict business or trade solely for the purpose of reservations for Malays and natives of any of the States of Sabah and Sarawak.
(9A) In this Article the expression 'natives' in relation to the State of Sabah or Sarawak shall have the meaning assigned to it in Article 161A (already repealed).
(10) The Constitution of the State of any Ruler may make provision corresponding (with the necessary modifications) to the provisions of this Article.
Jelas dari artikel ini kuota untuk orang Melayu dan pribumi Sabah dan Sarawak untuk jawatan di dalam kerajaan, biasiswa pelajaran, tempat belajar di IPTA, lesen dan permit perniagaan, dan lain-lain merupakan hak keistimewaan orang Melayu.
Kuasa untuk melaksanakan artikel ini adalah di bawah kuasa Raja-Raja Melayu. Parlimen tidak berkuasa untuk meminda artikel ini melainkan dipersetujui oleh Raja-Raja Melayu. Sebarang pengurangan dari jumlah hak keistimewaan yang telah diberikan tidak boleh dilakukan melainkan setelah diperkenankan oleh Raja-Raja Melayu.
Artikel ini adalah antara artikel-artikel yang perlu dipersetujui dalam quid pro quo sebagai persetujuan untuk menganugerahkan kerakyatan kepada orang-orang bukan Bumiputera pada Ogos 31hb, 1957. Ia adalah komitmen dan tanggangjawab Raja-Raja Melayu kepada rakyat asal yang telah didiskriminasi.
Walaupun perlaksanaan artikel ini mengambilkira agar hak orang lain, hak mendapat biasiswa pelajaran tidak dijanjikan kepada kaum bukan Bumiputera. Namun demikian, kerajaan berlaku adil dalam memberikan biasiswa kepada kaum bukan Bumiputera atas sebab-sebab tertentu.
Persoalannya, adakah meningkatkan peratusan biasiswa kepada kaum bukan Bumiputera melibatkan pengurangan biasiswa untuk bumiputera?
Biasiswa untuk Bumiputera telah dikurangkan pada tahun krisis kewangan 1997-98 oleh Menteri Kewangan Anwar Ibrahim. Adakah pengurangan itu mendapat perkenan Agong?
Jika tidak, bukankah kerajaan sepatutnya meningkatkan kembali kuota itu pada tahap lama, melainkan tidak diperkenankan oleh Agong?
Isu biasiswa ini bukan sesuatu yang boleh ambil mudah dan diguna sebagai justifikasi politik. Ia adalah hak yang telah diperlembagakan dan bukan hak yang disalah terma sebagai Kontrak Sosial yang mengikut Rouseau boleh dikajisemula dan hanya berdasarkan perjanjian "gentlement".
Adakah UMNO tidak lagi memperjuangkan hak orang melayu? Jika tidak UMNO, siapa pula yang akan perjuangkan?

All I can say is for now, GREAT CHANGE! Although things are not exactly as perfectly as we want it to be on the matter of JPA and PSD scholarships, we shall welcome this change with open arms, The educationmalaysia blog has a good post regarding this (no racism involved :P)

baguslah. finally got some changes at last. it's a good first step at least. i'm hoping this will be a string of good events, education wise.
Why have to get Agong's blessing ka matters like this? Tak paham leh. I hope the people would not politicize this issue as it is involving all the race issue all. But the truth in pint still remains, scholarships should ultimately go to DESERVING students. The uota bit, well... maybe we should push for more or something? If no quota then more ways to get by it right? No quota then suddenly 100% go to bumis? :P

Scholarship is a previlage and right. It is not the government's constitutional responsibility to provide scholarship, except for whats already constitiutionally provided in this article 153.
The issue I raised is not about politicising but raising a practise that has been taken for granted.
This article is embedded as part of the constitution that no parliamentary vote can change it, unless the raja2 melayu has agreed to the amendment.
This article falls under the power of the raja2 melayu and not mere executive power.
By right, any amendment and change in policies affecting the malays and bumi of sabah/sarawak wud need a royal accent.
Its just that the king has trusted the executive all this while and have not invoke their power on it.
THis is part of what the idiots call ketuanan melayu but I am not in the habit of dominating people, just calling whats right and wrong. It's merely kedaulatan melayu or kesinambungan melayu (malay sovereign continuity).
The spirit of article 153 is the same as DEB ie about allowing the malays to catch up. Without it, the malays preference was to send back all ethnicity not belonging to this geo-cultre of the area.
Hate to speak in this unmalay and uncivilised straight to the point manner. But most refuse to understand and prefer the crude reality way.

Untuk pengetahuan kamu, MARA menawarkan lebih kurang 1900++ biasiswa tahun ini. orang bukan melayu hanya mempunyai kewarganegaraan malaysia. dalam constituion itu, orang bukan melayu tidak boleh mempunyai 2 warganegara. mereka telah memilih untuk menjadi rakyat malaysia dan tidak lagi mempunyai kaitan dengan negara asal untuk menunjukkan kesetiaan kepada malaysia. pernahkah saudara pernah mendengar orang melayu yang membeli rumah di kawasan mewah seperti di bangsar dan damansara mendapat diskaun? walhal mereka tidak memerlukan bantuan ini lagi. DEB hanya dikuatkuasakan selama 20 tahun dan bukan selama-lamanya. timbalan perdana menteri pada masa DEP dilaksanakan, Tun Dr Ismail pernah berkata, "kalau DEP dilaksanakan, maka ia akan susah ditarik balik." adakan saudara suah lupa akan kegemilangan islam pada kurun ke-13? mereka tidak memerlukan pertolongan 100%. mana pergi ilmuwan islam yang tersohor pada zaman itu tidak ada lagi pada zaman ini? orang melayu sekarang hanya mempunyai buah fikiran untuk bekerja untuk kerajaan sahaja. galakkan mereka untuk menceburi bidang perniagaan. mentaliti 'bekerja untuk kerajaan perlu dihapuskan'
