KSU suspiciously corrupt, Gopal Sri Ram obviously wicked


Continuing last night's posting targeted aimed at former KSU of Ministry of Education, Dato Seri Alias Ahmad, Malaysiakini live report saw the KSU accused as corrupt by defense lawyer, Dato Akberdin Abdul Kadir. Extract below

10.21 pagi - Hakim Mahkamah Tinggi Kuala Lumpur Mohamed Zaini Mazlan menegur peguam bela kerana mengasak saksi dan menuduh bekas KSU Kementerian Pendidikan Alias Ahmad sebagai 'korup.'

Ini terjadi apabila peguam Rosmah Mansor Akberdin Abdul Kader menuduh Alias mempunyai kepentingan dalam projek hibrid solar.

"Saya kata pada kamu, ambil inisitatif sampai telefon lepas surat penolakan beliau, sebab datuk ada vested interest dalam projek ni...," kata Akberdin.

Bagaimanapun, Alias membalas, "tidak setuju."

Pada ketika ini, hakim Zaini menegur Akberedin.

"Beliau bukan orang yang sedang dibicarakan," katanya.
No protest from the DPP.

Tak pernah bayar satu sen pun untuk projek hibrid solar - Saksi

10.45 pagi - Bekas KSU Kementerian Pendidikan Alias Ahmad memberitahu mahkamah tiada bayaran yang dibuat kerajaan untuk projek hibrid solar di Sarawak.


Alias, yang merupakan saksi pendakwaan ke-12, berkata demikian ketika membetulkan cadangan peguam bela Akberdin Abdul Kader mengenai pembayaran pendahuluan yang diminta oleh Kementerian Pendidikan daripada Kementerian Kewangan pada 2016 untuk dibayar kepada Jepak Holdings.

Saksi berkata Kementerian Pendidikan meminta bayaran pendahuluan untuk kerja-kerja yang berkaitan dengan genset diesel di sekolah-sekolah di Sarawak dan bukan untuk projek hibrid solar.

Akberdin: Kita jangan confusekan mahkamah...

Alias: Payment ini bukan untuk solar hybrid. Untuk genset. Tak pernah dibayar satu sen pun untuk solar hybrid.

It is the talk among lawyers and within the corridor of power that Dato Seri Gopal Sri Ram is acting for Tun Dr Mahathir as the lawyer orchestrating the lawsuits against Dato Najib, Datin Rosmah, Dato Ahmad Zahid Hamidi, Ku Nan, and all the political prosecutions against UMNO leaders.

None of the charges have stick. Gopal and his bosses are wicked humans.


Contract not secured and payment not received. MoF official not entertain Rosmah's lobby or Najib's request for urgency. Where is the beef?

Whose money did the claim bribe paid came from?

12.15 tengah hari - Peguam bela Rosmah Mansor, Akberdin Abdul Kader sekali lagi mengasak saksi pendakwaan Alias Ahmad mengenai kepentingan Kementerian Pendidikan dalam projek hibrid solar.


Akberdin mencadangkan kepada bekas KSU Kementerian Pendidikan itu, bahawa kementeriannya itu menunjukkan minat yang lebih untuk mendapatkan bayaran pendahuluan untuk Jepak Holdings berbanding syarikat itu sendiri.

Peguam itu berkata walaupun Jepak tidak menulis surat kepada Kementerian Pendidikan atau Alias untuk mempercepat pembayaran, pihaknya selalu berkomunikasi dengan Kementerian Kewangan mengenai perkara itu.

"Jadi kalau saya katakan, yang ambil berat pasal payment ini adalah KPM, datuk. Depa (Jepak) tidak tulis surat pun. KPM yang ambil berat, tulis surat, hantar lagi," kata Akberdin.

Bagaimanapun, Alias tidak bersetuju dengan cadangan peguam bela Rosmah itu.
Hakim Mohamed Zaini Mazlan protested the insinuation made against the KSU and to keep the question limited to allegations against his client. Rather routine caution in any typical courtroom.

Court to resume on April 6th. Akberdin need at least two more hours with Alias.

Will the real culprit behind Sarawak solar project case get exposed tomorrow in court?


It is glaringly clear that the media coverage on the Sarawak solar project case is to constantly paint the picture Datin Seri Rosmah lobbied and pushed for the project to be awarded to Jepak Holdings and Dato Seri Najib requested the government officer to expedite the award to Jepak.

Understandably, it has political value to the previous PH government to demonise the former Prime Minister and his wife.

As of today, under the officially set-up Perikatan Nasional government, mainstream media is on the same agenda-setting mode to demonise Rosmah.

The headline today is Rosmah asking former Ministry of Education secretary-general, Dato Alias Ahmad to expedite payment to Jepak

One should be reminded of the court statement by Alias's predecesor, Tan Sri Mardinah Mohamad, in which the theme was the same.

Intentionally, it was not reported that Mardinah said the Prime Minister's request is taken seriously but we still insist it be done according to the proper procedures.

Thank god for social media for reporting another side of an event.

Rogue or ruse, depends on cabinet appointment


Till the politics stabilise, it is pointless to discuss or talk of anything else.

Over tea, two foreigners next to our table was asking for comments on politics. Guess he was too eager to express his view. Before we could reply, he gave his 10 second description.

"It is a relay race where someone was supposed to pass the baton i.e. to Anwar but he didn't want to. He had his sight on someone else further away i.e. Mukhriz. Before he could run to pass it, the someone dropped the baton".

The foreigner's comment was almost there, but he did not know that there was no "supposed passing of baton by that someone" to Anwar.

Not with Anwar's reliance on DAP support. PH government fell on merely the no DAP in government crying call and them shooting their own feet, including dropping the baton.

Fat lady not sing yet


Boy... the air is fresh and the park is setene and peaceful this morning.

Coming out of PWTC yesterday evening, there was a sense of relieve and victory. The possible Prime Minister may not be expected choice, but it is a fair compromise.

In a war, it is the final victory that counts and not to win every battle.

However, celebrating now could be premature. Expect this impasse to last at least a week.

Since the last posting, "Orang Malaya taking Sabah, Sarawak for granted" on February 20th, this blog stopped commenting on the power transition or claimed new government.

Few reasons, one being too many information which does not cross checked. It means certain side not honest and telling the truth.

Another being the situation is too fluid to comment and do any analysis. Anyway, what need be analysed have been done and variables laid out. Pointless to repeat and more so, with the continuous developments.

For months, this blog anticipated the month of February for the armageddon to happen. Water in the pot have been percolating for a while. It is time to boil over.

Why Daim's brother-in-law, Dr Mo hated AirAsia?


The consensus on the money paid by Airbus to Caterham is not an AirAsia offset but kickback. The few corporate Datoks and Tan Sris spoken to viewed the private ownership of Caterham does not qualify it as offset or in simpler language, discount paid back in kind.

In one teh tarik session, an attempt to figure out a way AirAsia could work itself out failed. Quid pro quo, CSR and several ideas suggested, but the lawyer heard to be hired, Ambiga will still be stuck with the ownership issue and the conflict with AirAsia's status as PLC.

Several retired airliners shared stories on the early days of Airbus and suspect the company only recently stopped their past practise. That was Rocky Bru's argument against praising Airbus as courageous.

The Star's scoop is a clever answer for AirAsia to temporarily ward of hostililities. It could be an afterthought, but report claimed BOD approved the use of Caterham for branding exercise. It legitimise Caterham to accept Airbus money and AirAsia is left with only the stickly issue of the emails. 

However, the response to Rocky is that it is no scoop. With Tan Sri Tony Fernandez as member of Star Publication BOD, it was leaked exam questions.

For Daim sake, charge Dzulkifli and let the chips fall where they may


It is already 40 days after the audio expose by MACC, but no Investigation Paper submitted by police to AG and any charges made.

Chief Commissioner, Latheefa Koya submitted the audio claimed to be given to her anonymously to  police. It was reported police spent 4 hours to record her statement.

Contrary to recent and previous statements (here and here) by IGP Tan Sri Hamid Bador, the relevant persons have yet to be called in and only indicate investigation is at a slow and reluctant pace.

Few days after the expose on January 8th, 2020, Tun Daim was asked for a response by media. As quoted by Sinar Harian, he said, "I want justice. Justice and truth, that's all." It is a loaded answer that could mean either or both ways.

As a former Magistrate, Daim should be aware that Latheefa's stunt is in contravention of the Penal Code 203. The reveal appeals to human rights activists, but its admissibility in question.

One MACC official confided privately, "I would not have done such a crazy thing."

Airbus's courage, Malaysia's lack of integrity


"An act of courage", the NST column by Prof Salleh Buang briefly explained the settlement in the UK Airbus judgement. He revealed it originated from an internal investigation by the company new CEO, Tom Enders.

Suspecting wrongdoings behind certain irregularities, Tom lodged a report to the authorities. It led to a crackdown to sack more than 100 staffbite the bullet and eventually, negotiated a settlement to pa US$4 billion fines to three countries.

Tom's action brought a closure and limit the liability to the company to allow it to continue as an on going concern.

However, it was certainly not the original intention. There was genuine integrity for corporate governance, accountability and transparency on the part of the CEO.

Sri Lanka acted swiftly to charge former CEO of SriLankan Airlines and his wife on February 6th, less than a week after news broke.

Surprisingly, there is no development in Malaysia despite MACC issued immediate statement. The slow pace raise suslicion of a cover-up.

Latheefa's MACC abused power to intimidate doctor, but will Hamid Bador's police do their job?


Latheefa Koya had just issued a statement informing Datin Seri Rosmah's absence from the court is no more an issue as she had valid medical certificate. Actually, it remains an issue.

In the first place, it is none of her fricking business as her typical bulldozer habit to get things her way have landed her in bigger trouble than she already is with her recent revealing of a suspected MACC intelligence tapping.

She has abused her position to encroach into the power of the court and the authority of a medical practitioner thus had committed contempt of court, breaching the Medical Act, and abuse of power under the Penal Code governing civil servants. 

Her statement today is merely a media drama of Latheefa trying to evade responsibility and avoid being investigated and subsequently charged for breaking the law.

The media was also an accomplice.

Orang Malaya taking Sabah, Sarawak for granted


The Utusan Sarawak headline on Thursday evening, "GPS bebas, tidak sertai Pakatan Nasional - Abang Johari" was certainly odd.

PN is a non-existent entity, thus the denial indirectly acknowledged its existent. A Sarawak blogger speculated it may have came up in recent meetings between Tun Dr Mahathir and Datuk Patinggi Abang Johari Tun Openg.

Nevertheless, it turned out that it was touched by Abang Jo during the PC as answer to a question from the press.

That explains.

Political parties and factions aligned in the rivalry on the power transition from Mahathir to Dato Seri Anwar Ibrahim been making claims Parliament seats held by Gabungan Parti Sarawak (GPS) are aligned to them.

To quote a private comment from a former Federal Minister made in July last year, "...the chess board strategy being made out - a lot of "political game strategist' just place GPS as if we don't think to decide."

After Abang Jo's statement, the sides still insist the same and merely modified their viraled claim with a variation of 2 to 4 seats going to the other side.

Orang Malaya seemed to be taking Sabah and Sarawak for granted.

After Airbus judgement, do Malaysians still wish to be seen in London?


Sieving through the news reports, and social media comments, the public at large failed to appreciate that their celebrated entrepreneurs created another milestone of achievement that “Now,  everyone could not have done”.

The spirit of “Malaysia Boleh” got two Malaysians linked to AirAsia registered in a London court together with Airbus, a world renown multinational and getting global coverage. It is an unthinkable branding strategy.

Being implicated in the judgement for corruption against Airbus. the two decision makers for the large orders for planes for AirAsia and AirAsia X are far from acquited from allegations of bribe.

Legally, an e-mail evidence linked the plane order to the sponsorship into Caterham F1 team which is privately owned by Tan Sri Tony Fernandez and Dato Kamaruddin Meranun. This was highlighted by fervent detractor of AirAsia, Wee Choo Keong in his blog here.

Caterham F1 venture was meant to raise the Airasia brand and get social media viral to the Gen Y market. Instead, the judgement put Malaysia on the map of shame. It may not matter to the penny pinching Malaysian travelers. But to the well-heeled where London is their second hometown, “Now, everyone are smeared” by the judgement.

The highly etiquette and good mannered British, who values moral and ethics, adherence to integrity and accountability, and generally about being proper, will not look at Malaysians in the same light again.

Big test awaits Latheefa Koya to investigate UK's Airbus judgement


If not for the latest twist on the on-going Bollywood epic drama of power transition with the backroom scene of UMNO's decision to merge with PPBM-PAS plan to maintain Tun Dr Mahathir as Prime Minister, the UK court judgement on bribery by Airbus would have made headline in Malaysia.

TMI headlined it as "AirAsia execs received US$50 million bribe from Airbus, UK court papers show". AirAsia and AirAsia X are implicated in the judgement against Airbus which had to pay fines to UK, France and US to the tune of €3.6 billion.

The approved judgement can be downloaded here. When can our court make public such documents than limit it to merely lawyers?

Tan Sri Tony Fernandez dan Dato Kamaruddin Meranun were not mentioned by name, but aspersions are already made of them following reports by UK daily, The Telegraph.

Both denied involvement and announced temporarily stepping out from execution positions within the AirAsia group.

How to dissolve Parliament, and dismiss or appoint a Prime Minister?


It is February and the fight for the position of Prime Minister between Tun Dr Mahathir and Dato Seri Anwar Ibrahim has begun for few months already after several losing by-elections by PH.

The real show is expected to begin soon. It should end by May, and could possibly end earlier at the  March Parliament seating.

Today is February 2nd, a day after Federal Territory's Day and there is an ambitous demonstration dubbed as Perhimpunan 020222 to demand dissolving of Parliament. For NGOs without backing of large organisations or political parties, it is considered ambitous to display the more than 300,000 anti-ICERD crowd in their promotion.

With government and administration in such a disarray due to internal bickering within the ruling coalition, Pakatan Harapan over power transition and sheer incompetence of cabinet Ministers that is leading to near breakdown of public administration, their call is to return back to the voters to decide.

However, dissolution of Parliament could terminate Mahathir's party from the political scene.

It is the in the same vein as Tun Dr Mahathir's earlier in-denial statement of the Wuhan Coronavirus virus epidemic to allow tourist from China in.

Economic Minister, Datok Seri Mohamed Azmin Ali was equally in-denial yesterday to say the economic implication is too early to tell.

There was also the reaction of Tourism Minister, Dato Mohamaddin Katapi to directive by Putrajaya mosque to disallow non-Muslim tourist visit.

Sprite is commonly associated with a refreshing soft drink brand. However, its actual meaning is elf or fairy. So, the title of this Chick Corea Akoustic Band jazz number is about morning fairy.

It was the song played on the headphone for this morning's 20 minute walk. The years have passed and the beginning of Chinese zodiac year of the rat is as good a time for rat-born to restart exercise routine.

Today is the third day in a row and still purely stretching exercises. Physically, it is fairly relieving and has a somewhat refreshing feel. However, its still far from a painfree life.

The morning fairy actually came from within to finally say enough with the pain and just do it.

When Sitham use afterthought as argument, its a lost cause


A renown lawyer whispered, "When prosecution is left to use afterthought as argument, it is indicative they are dumbfounded without any arguments to resist any application filed".

That was exactly the argument out-sourced and hired DPP for SRC case, Dato V Sithambaram used on Monday, 20 Jan 2020 to oppose Dato Najib's application to have a handwriting expert analyse the signature in the various documents, used as evidence.

Couldn't understand why Sitham tried hard to resist a request already made by defense at the time prosecution was presenting their case. There was endless streams of doubts raised by defense during cross examination.

Today, court decided to allowed for the documents to be analysed by the Australian experts brought by defense.

Justice Dato Nazlan Ghazlan claimed he allowed it for the sake of justice [read FMT here].

What coercion to amend an allowable unfinalised audit report?


The trial on the alleged tampering of 1MDB audit report resumed this week.

If one follows the mainstream media headlines and perhaps, content of the court coverage, one gets the impression that all the civil servants appearing as witness ganged up to blame Dato Najib.

There is a similar line to say he forced them to change the draft audit report because he was unhappy with certain mentioned opinion.

However, the  acknowledgement of one former, Director for National Audit Department (NAD), Saadatul Napisah Bashir Ahmad that the report is a draft and could be amended should throw the case out.

Despite any issue with the subsequent events, the power and discretion remained with the Auditor General, Tan Sri Ambrin Buang. He agreed to amend.

Kimanis by-election: Anifah vs Shafie, PSS vs RM


The syariah lawyer and BN candidate, Dato Mohamed Alamain must have been annoyed with the perception going around that his candidacy is of no significance.

In response he said he is not new in politics, came up from the grassroot, and mentioned grassroot is still with BN despite the previous MP left BN.

It is rather insensitive of him to utter such words because Dato Anifah Aman is helping his campaign. But, it is all water under the bridge. Small matter that could be resolved. The issue of Pas Sementara Sabah (PSS) is more than some young politician's mistake.

Apparently, Warisan candidate and former UMNO assemblyman, Dato Karim Bujang made the claim Anifah is nothing and not to be worried over. Karim said he is longer in politics than Anifah.

Sabah Chief Minister, Dato Shafie Apdal too said he is unafraid of Anifah.

Never challenge Anifah. It inspires him.

MACC's Watergate scandal


Datin Seri Rosmah is supposed to appear in court this morning, but was postphoned to 3 PM today.

MACC held a press conference, in which the trailer released yesterday mentioned of explosive audio revelation. True to the suspicion, the audio implicated Rosmah and the court collaborated to conveniently postphone her court appearance.

In the press conference, MACC Chief Commissioner, Latheefa Koya revealed publicly 9 sets of audio clipping of telephone conversations.

It involved former Prime Minister, Dato Najib Tun Razak, former MACC Chief Commissioner, Tan Sri Dzulkifli Ahmad, head of state of UAE, Dato Azeez Raheem, Rosmah and few others [see here].

Gloomy Malaysia: No peace and joy for 2020


With the government on a senseless spree of national asset sales, endless foreign borrowings and yet debt kept raising, larger budget passed in Parliament with revenue uncertain, and cutbacks made at will without pondering of larger impact on the economy, growth and peoples' welfare, indications were already bad for quite sometime.

Global economy began to expect a looming recessionary trend. Its obvious PH government does not seemed to know what to do, pressed the panic button, and kept politicising it by blaming 1MDB, Najib's policies, and BN 60 years failure, claimed just former-ed MOE Maszlee Malek.

Economic confidence were slipping in April 2019 and PH were slipping in youth support. By May 2019, Malaysia only realised global funds by-passed the country. More troubles ahead.

If not for the political drama of power transition diverting public attention from the impending economic hardship like what Hindustanis 2 hour movies used to be for the Indian masses, Malaysians would have panicked in 2018.

The latest survey from Merdeka Centre, if they can be trusted and its truly an independent survey not to please the paymaster, Malaysians have began to realise.

Maszlee sacked for Mahathir to re-outsmart Zahid


In the posting, "Rejoining UMNO means Zahid outsmarted Mahathir", the blog Permadu Malaysia predicted Tun Dr Mahathir to rejoin UMNO to deny Dato Seri Anwar Ibrahim from being #PM8.

It will enable him to stay on till APEC 2020 or the problems of the country resolved as he piled up more problems. Physically, it is not logical for him to stay on any longer. He is staying on till it is feasible to pass over power to someone he trust.

Expectedly many are unconvinced Dato Ahmad Zahid Hamidi outsmarted Mahathir, but rejoining UMNO means he unwittingly submitted to Zahid's wish. That could put Zahid in trouble since one plan of Mahathir upon returning from Okinawa, Japan is to see Dato Najib and Zahid in.

The existing cases of Najib does not indicate he will be send to the slammer in the near future of January and February before March parliament seating and May 2020, the month PH Council fixed as the date Mahathir to relinquish his position.

The  judicial application to the Federal Court to reopen investigation on the murder of Altantuya is not due till March. Even if Najib can be fixed up on trumped up claims, it is not so soon.
