RCI: DAP is not off the hook

You ask for it, you got it!

There was an interesting twist on Tuesday at The Royal Commission of Inquiry (RCI) that was much demanded by DAP but when formed, was boycotted by them and Teoh Beng Hock's family (on DAP lawyer's advice).

It is indeed a relief for DAP after Lee Wye Wing admitted in court that he paid money into DAP accounts for local community projects. Lee also admitted using Bumiputera frontman and companies to secure the projects.

That is what can happen at an RCI. Everything spilled out irrespective if there is legal relevance and case to make out of it.

DAP wanted an RCI and they've got it.

Lee's statement at the RCI highlighted two offense of "corruption" by DAP. One for channeling money from project into political party. That is the offense that got the popular late Dato Harun Idris in the slammer in late 70s. Secondly, it is an abuse of power to collude with Bumiputera to secure contract for DAP contractors.

Those offenses skew heavily on possible motives that DAP is involved in murdering young Teoh. Kit Siang should do his premature excitement on Mummy Foo than on an Ean Yong "acquital".

Coincidently, unlike the Government's position (not politicians okay?) for suicide, murder was the explanation that DAP badly wanted the people to believe.

If that is what they wanted, should that be what they get then?

For DAP, that is their way to continue to accuse MACC of murdering TBH. It fits the Chinese chauvanism politics they are nurturing.

Unfortunately, progress of the RCI have not been going well for DAP. The revelations from the various testimony by MACC officers is only making DAP look worse and worse by the day.


Not only is the revelation by businessman Lim Wye Wing bad for DAP, counsel for MACC, Dato Shafee Abdullah managed to expose that the much sentimental play that Teoh Beng Hock was going to register his marriage to his pregnant girlfriend the next morning was not true.

There were some pro-BN blogs speculating that the baby may not be that of Teoh Beng Hock. With no plans of marriage by Teoh Beng Hock, that possibility is not totally remote.

The demand by MCA that the baby is registered as not born out of wedlock but by a "spiritual" marriage looks superstitous and ridiculous. MCA's getting dumber and dumber by the day, don't they?
The only way for DAP is now to ignore and play dumb to what has transpired.

Since DAP is dead set to keep accusing MACC as murderer for their own political mileage, all the facts will be twisted and all small error by enlarged.

It will not matter to them if there is no motive or remotely sensible excuse to make such claim because the largely irrational Chinese population will believe hook, line and sinker whatever DAP say. Lim Kit Siang is their prophet and Tony Pua is boy wunder to them.

Just keep accusing "Melayu" authority kill "orang Cina" and Chinese voters for the 13th General Election will be solid behind DAP.

A window of oppurtunity appeared on Tuesday.

The RCI was informed that the MACC officer from Putrajaya, Ahmad Shafik Abdul Rahman @ Alwee, 32, who received the investigation papers on Aug 27, 2009, said: "We found nothing which could link Ean Yong to the offence under the section."

KUALA LUMPUR: There was no evidence to implicate Seri Kembangan assemblyman Ean Yong Hian Wah over alleged illegal disbursement of state funds, the Commission of Inquiry (RCI) into the death of Teoh Beng Hock heard Tuesday.

The Attorney-General's Chambers had instructed the Malaysian Anti-Corruption Commission (MACC) to stop the investigations, Putrajaya MACC investigating officer Ahmad Shafik Abdul Rahman told the commission.

Ahmad Shafik had taken over investigations from Selangor MACC officer Mohd Anuar Ismail after Teoh, who was Ean Yong's political secretary, was found dead on July 16, 2009, after being questioned by the state anti-graft body a day earlier.

Ahmad Shafik testified that the MACC was also not able to find evidence indicating that Ean Yong breached Section 18 of the MACC Act by committing an offence.

The officer also added that the receipts given to the MACC did not indicate that the DAP had received commissions from various programmes carried out by Ean Yong's office.

He added the payments made to the Serdang Aman and national DAP offices were reimbursement of money that was advanced to carry out the programmes.

According to Ahmad Shafik the money had been advanced because claims from the state could only be made after the programmes had been carried out.

With blazing speed of lightning, Lim Kit Siang seized on the opportunity to respond. He quickly revert to the tiring script of turning the table back to MACC and ignore the many discrepencies and inconsistencies by DAP.

MACC must take full blame for Beng Hock’s death, says Kit Siang

KUALA LUMPUR, April 26 — The Malaysian Anti-Corruption Commission (MACC) must now take full responsibility for Teoh Beng Hock’s death as investigations showed no proof of graft against his boss Ean Yong Hian Wah, said Lim Kit Siang today.

The DAP parliamentary leader said that the anti-graft body could no longer push the blame to the DAP as there was no motivation for Teoh to have committed suicide after being questioned at the Selangor MACC office on July 16, 2009.

“All fingers point back to MACC now,” he told The Malaysian Insider.

The Teoh Royal Commission of Inquiry (RCI) was told today that the MACC failed to find evidence to prove Selangor executive councillor Ean Yong abused state funds and the public prosecutor instructed it to stop investigations.

“Results from investigations showed there was no testimony that could link YB Ean to wrongdoing under section 18 of the MACC Act 2009,” acting senior superintendent Ahmad Shafik Abdul Rahman said at the inquiry today.

Lim said the lack of evidence showed that the investigation was politically motivated and done in bad faith.

“Right from the start MACC tried to implicate DAP. This is not something an independent agency should do.

“MACC should never have gone into this as it is another blow to their credibility,” the Ipoh Timur MP said.

Teoh was found dead on July 16, 2009 on the fifth-floor corridor of Plaza Masalam in Shah Alam after he was questioned overnight by MACC officers at their then-Selangor headquarters on the 14th floor.

Teoh, 30, was the political secretary to Ean Yong, the Seri Kembangan assemblyman from the DAP, at the time of his death.

A coroner’s inquiry into the death delivered an open verdict, ruling out both homicide and suicide.

The resulting outcry forced Prime Minister Datuk Seri Najib Razak to form the RCI, 18 months after Teoh fell to his death.
Uh Ah ... not too fast Kit.


The main reason MACC could not make a case against Ean Yong is because Teoh Beng Hock is dead.

There are many other questions to be asked and confirmations to be secured from Teoh against Ean Yong before a case could be made. This can't be done with Teoh's flying act down the Massalam Plaza.

With Teoh dead, MACC can't make a case against Ean Yong with just testimony by Lee Wye Wing at the RCI.


The reason being our judges are dumb and scared, or possibly corrupt as well. In Singapore, any confession is a sure case of a judgement in the prosecutor's favour. While in China, it is as good as 100%.

But our dumb Malaysian judges strangely do not believe in confession. They assumed that all confessions are obtained under duress. That is the reason why some the corrupt in some high profile case managed to get away.

There is the possibility the judges are scared at pinning Pakatan politicians for fear their jobs will be at stake when they takeover Government. And lastly there are corrupted judges on the take and what heard at Jalan Duta, pro Pakatan lawyers are the brokers.

The public should blame the judges when the corrupts get away. Politicians from both sides are protecting runner boys and proxies when the SPRM act was introduced. Dig up the Parliament hansards.
Coming back to Lee, what does that tell you?


Please do not bother asking that question to any DAP supporters and Chinese at large. They are programmed to only think and say along the line that "MACC is murderer", and "Malay stole their Perak Chinese Government."

While the only thing straight of DAP leaders are their hair. Case in point, Lim Guan Eng.

It is seemed as though DAP has a motive to kill Teoh to cover-up the wrongdoing and detour investigation on Ean Yong.

The police should realised that Ean Yong was a powerful man in DAP Selangor. He was DAP Selangor Chairman.


Another point to note.

MACC do not close any file. Any closure of files have to be referred to committees and it is not an easy task to close a file. It means MACC can reinvestigate Ean Yong and DAP if there is any new evidence comes up.

If you cannot understand that, you are just as dumb as Nizar Jamaluddin.

DAP better do a lot of praying and hope that the ghost of Teoh do not appear in some investigating officer of MACC's dream and give them the right lead.

This information only shows DAP is not off the hook.

It is pertinent that one get the proper facts, legal and procedural understanding, and sensible storyline. Follow the RCI at www.bheauu.gov.my.

Salam Tuan,

Solid write. Was thinking about that certain personality while reading your post but you got that covered when I reached your last para. That made your piece complete.

Pity the TBH family though, having been pulled by the nose. More pitiful if they still put their faith in the DAP in their quest for answers or justice.

Surely it would be incumbent on the MCA to highlight and convince the family on the many grounds, and manner articulated, you have put forward.

How to regain the confidence of the Chinese community like this?

Problem is MCA has a lack of confidence and is still in a state of denial.

Chua Soi Lek keep blaming others than themselves.

First he blame UMNO, then Perkasa and now Utusan.

Does he realised the common Chinese rather listen to and support NGOs than MCA.

Perhaps he realised this because he sabotage any Chinese NGOs that come to campaign for BN.
